What is TDS?

Tax Deducted at Source (TDS) is a mechanism under the Indian Income Tax Act where the payer deducts a specified percentage of tax from certain payments — salary, rent, professional fees, interest, dividends — before making the payment. The deducted amount is deposited with the government, and the recipient gets credit for it when filing their income tax return.

Which section applies?

Each type of payment has its own section: Section 192 for salary (slab-based), 194A for interest, 194C for contractor payments (1% individual, 2% company), 194J for professional/technical fees (10% professional, 2% technical), 194I for rent (10% land/building, 2% plant), and so on.

Frequently Asked Questions

What happens if TDS is not deducted when required?
Under Section 201 of the Income Tax Act, failure to deduct TDS makes the payer liable to pay the undeducted amount plus interest at 1% per month (for non-deduction) or 1.5% per month (for non-deposit after deduction). Disallowance of the payment as a business expense is also possible under Section 40(a)(ia).
What is the TDS rate when PAN is not provided?
Under Section 206AA, if the deductee does not furnish their PAN, TDS must be deducted at the higher of: (a) the rate specified in the section, (b) the rate in force (as per the Finance Act), or (c) 20%. For most payments this means 20% applies when PAN is absent.
Is surcharge always applicable?
Surcharge on TDS applies only when the recipient is an individual with income above ₹50 lakh (10%), ₹1 crore (15%), etc., or a company with income above ₹1 crore. For most routine payments to individuals with income below ₹50 lakh, surcharge is 0%. The tool lets you set the surcharge manually if applicable.
Why does Section 192 (salary) show 0% TDS here?
Salary TDS under Section 192 is based on the employee's estimated total taxable income for the year, applied at slab rates. There is no fixed percentage — the employer calculates TDS by estimating annual income, applying old or new regime slabs, and deducting it proportionally. Are these rates current for FY 2024–25?
Rates reflect the Finance Act 2024 effective April 2024. TDS rates are revised each year in the Union Budget. Always verify with a Chartered Accountant or the official Income Tax India portal (incometaxindia.gov.in) before filing.
